Startop Labradors
Sales Agreement
This contract is between Startop Labradors (Jen Harmon) herein after
referred to as "Seller" and ___________________ herein after referred to
as "Buyer(s)" In consideration of payment in full of the purchase price
of $_____, by Buyer(s) to Seller, Seller agrees to transfer to Buyer(s),
subject to the terms and conditions contained in this contract, the
ownership of one Male / Female Labrador puppy, herein after referred to
as the "Puppy" or “Dog“ (regardless of age), from the mating of the sire
and dam identified below.

All puppies are sold with Limited Registration *AKC definition of
“Limited Registration” means that the dog is registered, but no litter
produced by the dog is eligible for registration. Dogs with Limited
Registration may not be entered in breed competition at Dog Shows but
may compete in all other AKC events (obedience, agility, rally, etc.).
Seller may later apply to change this designation and have the dog given
Full Registration privileges if seller agrees that puppy is a suitable
representative of the breed for showing and/or breeding and has passed
minimum health clearances (hips, elbows, eyes). Seller may or may not
require to be added as co owner on the dog if it is agreed that Full
Registration will be applied for. Seller will reserve breeding rights to
all male puppies that are to be used at stud.
It is understood that at the time of sale this puppy has been evaluated
by the breeder with respect to other representatives of the breed at
approximately the same age and has been determined to be structurally
and temperamentally suited to be a companion, hunting, agility and/or
obedience dog. This does not imply the puppy is or is not of breeding or
show quality.
Health Warranty
A full refund will be given to Buyer(s) for any puppy found to be unfit
for sale within 14 days of purchase, provided the following is met.
Failure to comply with and provide documentation of these requirements
voids all guarantees. Warranty is no longer valid if the dog has
produced a litter.
1) If the puppy is found to be ill, by a licensed Veterinarian, the
breeder is to be notified within 24 hours. A refund of the purchase
price will follow the return of the puppy and all papers to the breeder,
including a written statement from the attending veterinarian stating
the dog's condition (unfit for sale).
2) Buyer(s) warrants that the puppy will be kept in appropriate
conditions for its health and welfare. Puppy will be fed a suitable diet
for its age and condition. Puppy will receive all necessary veterinary
care to maintain its good health.
3) If the puppy is due for vaccinations and the Buyer(s) fails to
provide vaccinations on time, this warranty is null and void if the
puppy contracts diseases that would otherwise be prevented by those
vaccinations.
Hereditary Defect Warranty
The seller represents and warrants the following to the original
purchaser until the dog reaches 26 months of age: Seller cannot warrant
the following if the pup is overweight and/or has had improper
nutrition, excess exercise, accident or injury that may alter the
results or if the animal is spayed/neutered prior to the age of 12
months.
This puppy is guaranteed against the following hereditary defects as
defined below:
a) Dysplasia of the hips to such extent that quality of life is
affected. Diagnosis MUST be made by the Orthopedic Foundation of Animals
(OFA) at the Buyers expense. This warranty is valid until 26 months of
age. Certification can be obtained at the expense of buyer at or prior
to 26 months of age *see OFA guidelines.
b) Dysplasia of the elbows to such extent that quality of life is
affected. See above for OFA guidelines.
c) Hereditary defects of the eyes which cause visual loss or impairment.
Certification must be done by an AVCO & registered through the Canine
Eye Registration Foundation (CERF).
It is understood that there is no absolute guarantee that a breeding
program can be fully certain that no problems will develop. More
information on hereditary defects can be viewed at www.OFA.com. If a
heredity defect of hip/elbow/or eye is diagnosed (with nothing else
being the cause) a replacement puppy shall be given to the buyer out of
the next available litter. Buyer(s) must give notice of the defect in
writing to the seller from a licensed veterinarian, along with all
documentation from organization (OFA, CERF) stating the problem. It is
not required that buyer(s) return the original puppy to collect on this
warranty, but buyer(s) must provide proof of spay/neuter prior to
receiving replacement. Veterinarian records for puppy must be supplied
from the time of purchase that includes any/all injuries, weight at
periodic checkups, and all shot records.
Seller reserves the right to have the puppy examined by Sellers vet.
Temperament Warranty
Your puppy carries a lifetime temperament guarantee under the conditions
that he/she successfully attends a properly run puppy/dog obedience
class which uses positive reinforcement training methods, and the puppy
is never harmed or mistreated in any way. Should it be proven that the
puppy has been harmed or mistreated, this temperament guarantee is null
and void.
As responsible breeders we expect that this puppy be properly
socialized. We have done everything possible to breed dogs of sound mind
(temperament) and body. The rest is the responsibility of the Buyer(s).
Proper feeding, exercise, socializing and training all have a bearing on
the end results of a sound adult dog. If a temperament problem is
arrises, and seller agrees that Buyer(s) have done their best to resolve
the problem to no avail, the puppy must be returned to seller and
replacement puppy will be given at a discounted price.
MISC.
If, at any time, Buyer(s) are unable or unwilling to care for this
puppy, Buyer(s) agrees to contact and return puppy to Seller. Neither
REFUND, NOR REPLACEMENT PUPPY WILL BE GIVEN.
Buyer(s) agrees to and understands the following conditions: The puppy
shall not be sold, leased or given to any pet shop, supplier,
wholesaler, shelter, pound, humane society or research establishment.
The puppy shall not be sold, given or donated to any person without the
Seller's prior knowledge and consent. Buyer(s) further agree that this
puppy shall not be used for medical or any other experimental purposes.
Buyer agrees to notify Seller within 10 days of any change of address or
phone #.
This contract contains the entire agreement between the parties and no
statement or verbal agreements made by either party that are not
contained in this written contract shall be valid or binding. This
contract may not be modified or altered except in writing and signed by
both parties. Violations of this Contract will constitute BREACH of
CONTRACT, prosecutable by law and may result in mandatory confiscation
and return of the puppy to the Seller.
I have read and understand the stipulations of the contract and
voluntarily agree to all elements, stipulations and provisions herein.
